Arlen Specter
Arlen Specter (born February 12, 1930) is the senior United States Senator from Pennsylvania and a member of the Republican Party. Elected in 1980, he is currently the 12th-most senior member of the U.S. Senate as well as 5th most senior Republican in this body.
Specter has been Pennsylvania's senior senator since April 4, 1991. He is known as a moderate Republican, with liberal leaning views for abortion, same-sex marriage and immigration. In April 2006, he was selected by Time as one of "America's 10 Best Senators".
Specter was born in Wichita, Kansas, to Jewish parents Lillie Shanin and Harry Specter. He was raised in Russell, Kansas (also the hometown of 1996 Republican Presidential nominee Bob Dole). His father's occupations were peddler, tailor and junkyard owner; both his parents had immigrated to the United States from Russia. Specter studied at various universities before and after serving in the United States Air Force from 1951 to 1953, during the Korean War. He graduated Phi Beta Kappa from the College of Arts and Sciences at the University of Pennsylvania, majoring in International Relations, in 1951 and from Yale Law School in 1956. He passed the Pennsylvania Bar examination in 1956. While at Penn, Specter was a member of Pi Lambda Phi fraternity. He married his wife Joan, and together they reside in Philadelphia. They have two sons, Shanin and Steve, and four grandchildren, Silvi, Perri, Lilli, and Hatti.
After graduating from the University of Pennsylvania and Yale Law School, Specter became a prominent lawyer in Philadelphia and active in politics, beginning his political life as a Democrat. At the recommendation of Rep. Gerald R. Ford, he worked for the Warren Commission, investigating the assassination of John F. Kennedy. As an assistant counsel for the commission, he authored or co-authored the controversial "single bullet theory," which suggested the wounds to President Kennedy and non-fatal wounds to Texas Governor John Connally were caused by the same bullet. This was a crucial assertion for the Warren Commission, since if the two had been wounded by separate bullets, that would have demonstrated the presence of a second assassin and therefore a conspiracy.
He eventually became a Republican and scored an upset by winning a 1965 race for District Attorney in Philadelphia, running on an anti-corruption platform against the Democrats. His slogan was, "We need these guys to watch those guys." Although a death penalty supporter, as prosecutor he questioned the fairness of the Pennsylvania death penalty statute in 1972.
In 1967, he mounted an unsuccessful campaign for mayor of Philadelphia against incumbent James H. J. Tate. After serving two terms as district attorney, he was defeated in the 1976 Republican primary for U.S. Senate by John Heinz and in the 1978 primary for Governor of Pennsylvania by Dick Thornburgh.
On February 16, 2005, Specter announced that he had been diagnosed with an advanced form of Hodgkin's lymphoma, a type of cancer. Despite the advanced form, Specter continued working during chemotherapy. He ended treatment on July 22. Senator John Sununu (R-New Hampshire) shaved his head to show solidarity with Specter when he was undergoing chemotherapy and was temporarily bald. On April 15, 2008, he announced his cancer had returned, though at a stage "significantly less advanced than his Hodgkin's disease when it was originally diagnosed in 2005." He underwent a second round of chemotherapy, which ended on July 14, 2008.
Specter was first elected to the Senate in 1980. He is the longest-serving Senator in Pennsylvania's history; no one else from the state has been elected to five terms in that body. According to polls by Quinnipiac University, Specter has a higher approval rating among Democrats in Pennsylvania than Republicans, 62-55 respectively.
His opposition to Supreme Court nominee Robert Bork is seen as an important factor in the nomination's failure; indeed, many conservative Republicans have never forgiven him for opposing Bork. However, he raised the ire of many Democrats who had supported him for years with his aggressive questioning of Anita Hill during the Clarence Thomas hearings, claiming Professor Hill had committed "flat-out perjury" in her testimony.
In 1998 and 1999, Specter criticized his own party for its impeachment of President Bill Clinton. Believing that Clinton had not received a fair trial, Specter famously cited Scots law to render a verdict of "not proven" on President Clinton's impeachment. However, his verdict was recorded as "not guilty" in the Senate records.
Soon after the 2004 election, Specter stepped into the public spotlight as a result of controversial statements about his views of the future of the Supreme Court. At a press conference, he stated that "when you talk about judges who would change the right of a woman to choose, overturn Roe vs. Wade, I think is unlikely. The president is well aware of what happened, when a number of his nominees were sent up, with the filibuster. ... And I would expect the president to be mindful of the considerations which I am mentioning." Activist groups interpreted his comments as warnings to President Bush about the implications of nominating Supreme Court justices who are opposed to the Roe v. Wade decision.
Specter maintained his comments were a prediction, not a warning. He met with many conservative Republican senators, and based on assurances he gave them, he was recommended for the Judiciary Committee's chairmanship in late 2004. He officially assumed that position when the 109th Congress convened on January 4, 2005. The Judiciary Committee is responsible for holding hearings on federal judicial nominations made by the President, including Supreme Court nominees, for oversight of the United States Department of Justice, and for other matters.
On 9 March 2006, the USA PATRIOT Improvement and Reauthorization Act of 2005 was signed into law. It amended the process for interim appointments of U.S. Attorneys, written into the bill by Arlen Specter during his chairmanship of the Senate Judiciary Committee. The change allowed the Bush Administration to appoint interim U.S. attorneys without term limits, and without confirmation by the Senate. The Bush administration used the law to place at least eight interim attorneys into office in 2006. Specter claims that the changes were added by staff member Brett Tolman. Specter has been very critical of President Bush's wiretapping of US persons without warrants. When the story first broke, he called the effort "inappropriate" and "clearly and categorically wrong." He said he intended to hold hearings into the matter early in 2006, and had Alberto Gonzales appear before the Senate Judiciary Committee to answer for the program (though Specter declined to force Gonzales to testify under oath). On January 15, 2006, Specter mentioned impeachment and criminal prosecution as potential remedies if President Bush broke the law, though he downplayed the likelihood of such an outcome.
However, he voted for the 2008 amendments to the Foreign Intelligence Surveillance Act, which placed federal electronic searches almost entirely within the executive branch.
Specter voted in favor of the Senate's version of the American Recovery and Reinvestment Act of 2009 on February 10, 2009; he was one of only three Republicans to break ranks with the party and support the bill, which was favored by President Barack Obama and was unanimously supported by the Democratic senators. As a result of his support, many in the Republican mainstream have begun to set up attack ads calling for his removal from office. Specter was instrumental in ensuring that the act allocated an additional $10 billion to the National Institutes of Health over the next 2 years.
Specter was chairman of the Senate Select Committee on Intelligence from 1995, when the Republicans gained control of the Senate, until 1997, when he became chairman of the Committee on Veterans Affairs. He chaired that committee until 2001 and again from 2003 to 2005, during the times the Republicans controlled the Senate. He also chaired the Judiciary Committee from 2005 to 2007.
In 1980, Specter became the Republican nominee for Senate when Republican incumbent Richard Schweiker announced his retirement. He faced the former Mayor of Pittsburgh Peter F. Flaherty. Specter won the election by a 2.5% margin. He was later reelected in 1986, 1992, 1998 and 2004, despite 1992 and 1998 being bad years for Republicans. Specter will run for reelection in 2010.
On March 31, 1995 Arlen Specter announced his candidacy for President of the United States, to challenge the incumbent Bill Clinton. He entered the race claiming his party needed a candidate who did not have the stereotypical religious conservative image. He was critical of Patrick J. Buchanan, Pat Robertson and Ralph E. Reed, Jr., saying all three were far too conservative, while America needed a moderate, "Neither this nation nor this party can afford a Republican candidate so captive to the demands of the intolerant right that we end up re-electing a President of the incompetent left." His campaign focused on balancing the federal budget, strict crime laws, and restoring relations with Israel and North Korea. "My commitment to America," Mr. Specter said, "is to replace a President who has been inattentive, inactive and indecisive when it comes to America's vital foreign policy interests." His candidacy was not expected to succeed in winning the Republican nomination due to the overwhelmingly large number of social conservatives in the Republican Party. He was however able to gain support: Although fellow Pennsylvania Senator Rick Santorum (noted for his social conservatism) was never overly enthusiastic, he was supportive. Other supportive Republicans were hopeful Specter could trim the party's "far-right fringe." Although his campaign was ultimately unsuccessful at wooing conservatives, it was widely believed he could have had a strong showing among independents. On November 23, 1995, before the start of the primaries, Specter suspended his campaign to endorse Bob Dole.
In 2004, Specter faced a challenge in the Republican primary election from conservative Congressman Pat Toomey. Toomey's campaign theme was that Specter, a moderate, was not fiscally conservative enough. The match-up was closely watched nationally, being seen as a symbolic clash between the conservative and moderate wings of the Republican Party. However, most of the state and national Republican establishment, including the state's other senator at the time, Rick Santorum, (who was widely seen as only slightly less conservative than Toomey), closed ranks behind Specter. Specter was strongly supported by President George W. Bush. Specter narrowly avoided a major upset with 51 percent of the primary vote. Once Specter defeated the challenge from the right, he was able to enjoy great support from independents and some Democrats in his race against Hoeffel. Hoeffel also trailed Specer in name recognition, campaign funds and poll results. Although the two minor candidates were seen as more conservative than Specter, they were only able to take 4% of the vote and Specter was easily reelected.
Specter is generally considered pro-choice on abortion. Despite this he has voiced his personal opposition to abortion and received a 20% from the NARAL indicating a pro-life record. Although he maintains he is pro-choice, he wants abortion to be a safe and rare occurrence. Bobby Casey's election in 2006 gives Pennsylvania the distinction of being represented in the Senate by a pro-life Democrat and a pro-choice Republican; each holds the position opposite to what is common for their respective national parties.
Specter supports LGBT rights with mixed positions. He is opposed to same-sex marriage, but is also opposed to a federal ban and supports civil unions. He personally believes marriage should be between one man and one woman.
On the immigration issue, Specter supports a "pathway to citizenship" and a "guest worker program" which opponents call amnesty. He introduced Senate bill S. 2611 (the Comprehensive Immigration Reform Act of 2006) on 6 April 2006, which was passed by the Senate on 25 May 2006 before reaching a stalemate in the House.
Specter strongly supports the death penalty and opposes most gun control, voting against the Brady Bill, background checks at gun shows, the ban on assault weapons, and trigger locks for handguns. His work has included numerous articles on the deterring effect the death penalty has on future crimes.
He supports affirmative action and voted for the Civil Rights Act of 1990. He was one of only four Republicans to vote against the Private Securities Litigation Reform Act and in recent years has been less enthusiastic about weakening consumer protection laws than many members of his party. In 1995 he was the only Republican to vote to limit tax cuts to individuals with incomes of less than one million dollars. He voted against CAFTA. Specter also supports an increase in the federal minimum wage. He is a leading supporter of the U.S. Public Service Academy.
Pennsylvania
The Commonwealth of Pennsylvania ( /ˌpɛnsɨlˈveɪnjə/ (help·info)), often colloquially referred to as PA (its postal abbreviation which succeeds the archaic Penn. and Penna. as common abbreviations) by natives and Northeasterners, is a state located in the Northeastern and Middle Atlantic regions of the United States. The state borders Delaware and Maryland to the south, West Virginia to the southwest, Ohio to the west, New York and a water border with Canada to the north, and New Jersey to the east. The state's most populated city is Philadelphia.
Pennsylvania has been known as the Keystone State since 1802, based in part upon its central location among the original Thirteen Colonies forming the United States. It was also a keystone state economically, having both the industry common to the North, making such wares as Conestoga wagons and rifles, and the agriculture common to the South, producing feed, fiber, food, and tobacco.
Another one of Pennsylvania's nicknames is the Quaker State; in colonial times, it was known officially as the Quaker Province, in recognition of Quaker William Penn's First Frame of Government constitution for Pennsylvania that guaranteed liberty of conscience. He knew of the hostility Quakers faced when they opposed religious ritual, taking oaths, violence, war and military service, and what they viewed as ostentatious frippery.
Pennsylvania has 51 miles (82 km) of coastline along Lake Erie and 57 miles (92 km) of shoreline along the Delaware Estuary.
Pennsylvania is 170 miles (274 km) north to south and 283 miles (455 km) east to west. Of a total 46,055 square miles (119,282 km2), 44,817 square miles (116,075 km2) are land, 490 square miles (1,269 km2) are inland waters and 749 square miles (1,940 km2) are waters in Lake Erie. It is the 33rd largest state in the United States.
The bounds of the state are the Mason-Dixon Line (39° 43' N) in the south, the Delaware River in east, 80° 31' W on the west, and the 42° N parallel on the north, with the exception of a short segment on the western end, where a triangle extends north to Lake Erie. Pennsylvania borders six other states: New York to the north; New Jersey to the east; Delaware and Maryland southeast; West Virginia southwest, and finally Ohio to the west. Pennsylvania also shares a water border with Canada.
It has cities of Philadelphia in the south-east, Pittsburgh in the central-west, tri-cities of Allentown, Bethlehem, Easton in the central-east, Scranton and Wilkes-Barre in the north east, and Erie in the north-west, with state capital Harrisburg on the Susquehanna River in the central region of the commonwealth.
Pennsylvania's diverse geography also produces a variety of climates. Straddling two major zones, the southeastern corner of the state has the warmest climate. Greater Philadelphia lies at the southernmost tip of the humid continental climate zone, with some characteristics of the humid subtropical climate that lies in Delaware and Maryland to the south. Moving toward the mountainous interior of the state, the climate becomes markedly colder, the number of cloudy days increases, and winter snowfall amounts are greater. Western areas of the state, particularly cities near Lake Erie, can receive over 100 inches (254 cm) of snowfall annually, and the entire state receives plentiful rainfall throughout the year.
Before the Commonwealth was settled, the area was home to the Delaware (also known as Lenni Lenape), Susquehannock, Iroquois, Eriez, Shawnee, and other Native American tribes.
In 1681, Charles II granted a land charter to William Penn, to repay a debt of £20,000 (around $30,000,000 in 2007) owed to William's father, Admiral Penn. This was one of the largest land grants to an individual in history. It was called Pennsylvania, meaning "Penn's Woods", in honor of Admiral Penn. William Penn, who had wanted his province to be named "Sylvania", was embarrassed at the change, fearing that people would think he had named it after himself, but King Charles would not rename the grant.
Penn established a government with two innovations that were much copied in the New World: the county commission, and freedom of religious conviction.
Between 1730 and when it was shut down by Parliament with the Currency Act of 1764, the Pennsylvania Colony made its own paper money to account for the shortage of actual gold and silver. The paper money was called Colonial Scrip. The Colony issued "bills of credit" which were as good as gold or silver coins because of their legal tender status. Since they were issued by the government and not a banking institution, it was an interest-free proposition, largely defraying the expense of the government and therefore taxation of the people. It also promoted general employment and prosperity since the Government used discretion and did not issue too much to inflate the currency. Benjamin Franklin had a hand in creating this currency, of which he said its utility was never to be disputed, and it also met with the "cautious approval" of Adam Smith.
After the Stamp Act Congress of 1765, Delegate John Dickinson of Philadelphia, Pennsylvania wrote the Declaration of Rights and Grievances. The Congress was the first meeting of the thirteen colonies, called at the request of the Massachusetts Assembly, but only nine colonies sent delegates. Dickinson then wrote Letters from a Farmer in Pennsylvania, To the Inhabitants of the British Colonies, which were published in the Pennsylvania Chronicle between December 2, 1767, and February 15, 1768.
When the Founding Fathers of the United States were to convene in Philadelphia in 1774, 12 colonies sent representatives to the First Continental Congress. The First Continental Congress drew up and signed the Declaration of Independence in Philadelphia, but when that city was captured by the British, the Continental Congress escaped westward, meeting at the Lancaster courthouse on Saturday, September 27, 1777, and then to York. There they drew up the Articles of Confederation that formed 13 independent colonies into a new nation. Later, the Constitution was written, and Philadelphia was once again chosen to be cradle to the new American Nation.
Pennsylvania became the second state to ratify the U.S. Constitution on December 12, 1787, five days after Delaware became the first.
Dickinson College of Carlisle was the first college founded in the United States. Established in 1773, the college was ratified five days after the Treaty of Paris on September 9, 1783. The school was founded by Benjamin Rush and named after John Dickinson.
For half a century, the Commonwealth's legislature met at various places in the general Philadelphia area before starting to meet regularly in Independence Hall in Philadelphia for 63 years. But it needed a more central location, as for example the Paxton Boys massacres of 1763 had made them aware. So, in 1799 the legislature moved to the Lancaster Courthouse, and finally in 1812 to Harrisburg. The legislature met in the old Dauphin County Court House until December 1821, when the Redbrick Capitol was finished. It burned down in 1897, presumably because of a faulty flue. The legislature met at Grace Methodist Church on State Street (still standing), until the present capitol was finished in 1907.
The new state Capitol drew rave reviews. Its dome was inspired by the domes of St. Peter's Basilica in Rome and the United States Capitol. President Theodore Roosevelt called it the "the most beautiful state Capitol in the nation", and said "It's the handsomest building I ever saw" at the dedication. In 1989, the New York Times praised it as "grand, even awesome at moments, but it is also a working building, accessible to citizens ... a building that connects with the reality of daily life".
Pennsylvania accounts for nine percent of all wooded areas in the United States. In 1923 President Calvin Coolidge established the Allegheny National Forest under the authority of the Weeks Act of 1911 in the northwest part of the state in Elk, Forest, McKean, and Warren Counties for the purposes of timber production and watershed protection in the Allegheny River basin. The Allegheny is the state's only national forest.
James Buchanan, of Franklin County, was the only bachelor President of the United States and the only one to be born in Pennsylvania. The Battle of Gettysburg — the major turning point of the Civil War — took place near Gettysburg. An estimated 350,000 Pennsylvanians served in the Union Army forces along with 8,600 African American military volunteers.
Pennsylvania was also the home of the first commercially drilled oil well. In 1859, near Titusville, Pennsylvania, Edwin L. Drake successfully drilled the well, which led to the first major oil boom in United States history.
The center of population of Pennsylvania is located in Perry County, in the borough of Duncannon.
As of 2006, Pennsylvania has an estimated population of 12,440,621, which is an increase of 35,273 from the previous year, and an increase of 159,567 since the year 2000. Net migration from other states resulted in a decrease of 27,718, and immigration from other countries resulted in an increase of 126,007. Net migration to the Commonwealth was 98,289. Migration of native Pennsylvanians resulted in a decrease of 100,000 people. In 2006, 5.00% of Pennsylvanians were foreign born (621,480 people). The state has an estimated 2005 poverty rate of 11.9%. The state also has the 3rd highest proportion of elderly (65+) citizens in 2005.
Foreign-born Pennsylvanians are largely from Asia (36.0%), Europe (35.9%), Latin America (30.6%), 5% coming from Africa, 3.1% coming from North America, and 0.4% coming from Oceania.
Pennsylvania's reported population of Hispanics, especially among the Asian, Hawaiian and White races, has markedly increased in recent years. The Hispanic population is greatest in Allentown, Reading and around Philadelphia, with over 20% being Hispanic. It is not clear how much of this change reflects a changing population, and how much reflects increased willingness to self-identify minority status.
Pennsylvania's population was reported as 5.9% under 5 and 23.8% under 18, with 15.6% were 65 or older. Females made up 51.7% of the population.
The five largest ancestry groups self-reported in Pennsylvania are: German (27.66%), Irish (17.66%), Italian (12.82%), English (8.89%) and Polish (7.23%).
Of all the colonies, only in Rhode Island was religious freedom as secure as in Pennsylvania - and one result was an incredible religious diversity, one which continues to this day.
Pennsylvania is also noted for having the highest concentration of an Amish population in the United States.
While Pennsylvania owes its existence to Quakers and many of the older trappings of the Commonwealth are rooted in the teachings of the Religious Society of Friends (as they are officially known), practicing Quakers are a small minority today.
Pennsylvania's 2007 total gross state product (GSP) of $531.31 billion ranks the state 6th in the nation. If Pennsylvania were an independent country, its economy would rank as the 18th largest in the world. On a per-capita basis, Pennsylvania's per-capita GSP of $34,619 ranks 26th among the 50 states.
Philadelphia in the southeast corner, Pittsburgh in the southwest corner, Erie in the northwest corner, Scranton-Wilkes-Barre in the northeast corner, and Allentown-Bethlehem-Easton in the east central region are urban manufacturing centers. Much of the Commonwealth is rural; this dichotomy affects state politics as well as the state economy. Philadelphia is home to eight Fortune 500 companies, with more located in suburbs like King of Prussia; it's a leader in the financial and insurance industry. Pittsburgh is home to seven Fortune 500 companies, including U.S. Steel, PPG Industries, H.J. Heinz, and Alcoa. In all, Pennsylvania is home to fifty Fortune 500 companies.
As in the US as a whole and in most states, largest private employer in the Commonwealth is Wal-Mart, followed by the University of Pennsylvania, United Parcel Service and Giant Food (called Stop and Shop in other states). The largest manufacturing employer is Merck.
Pennsylvania ranks 19th overall in agricultural production, but 1st in mushrooms, 3rd in Christmas trees and layer chickens, 4th in nursery and sod, milk, corn for silage, grapes grown (including juice grapes), and horses production. It is also 8th in the nation for Wine County, Pennsylvania. The term "Dutch," when referring to the Pennsylvania Dutch, means "German" or "Teutonic" rather than "Netherlander." Germans, in their own language, call themselves "Deutsch," which in English became, misleadingly, "Dutch." The Pennsylvania Dutch language is a descendant of German, in the West Central German dialect family. The language is only very rarely used as a first language among Pennsylvanians; however, in eastern and south central areas of the state it is a common second language and greatly influences dialect and accent.
Pennsylvania has had five constitutions during its statehood: 1776, 1790, 1838, 1874, and 1968. Prior to that, the province of Pennsylvania was governed for a century by a Frame of Government, of which there were four versions: 1682, 1683, 1696, and 1701. The capital of the Commonwealth is Harrisburg. The legislature meets in the State Capitol there.
The current Governor is Ed Rendell, a former head of the Democratic National Committee who began as a popular District Attorney and mayor in Philadelphia. The other elected officials composing the executive branch are the Lieutenant Governor Joseph Scarnati, Attorney General Tom Corbett, Auditor General Jack Wagner, and State Treasurer Robert McCord.
Pennsylvania has a bicameral legislature set up by Commonwealth's constitution in 1790. The original Frame of Government of William Penn had a unicameral legislature. The General Assembly includes 50 Senators and 203 Representatives. Joseph B. Scarnati III is currently President Pro Tempore of the State Senate, Dominic Pileggi the Majority Leader, and Robert J. Mellow the Minority Leader. Keith R. McCall is Speaker of the House of Representatives, with Todd A. Eachus as Majority Leader and Samuel Smith as Minority Leader. As of the 2008 elections, the Democrats have a narrow majority in the state house and the Republicans retain their lead in the state senate.
Pennsylvania is divided into 60 judicial districts, most of which (except Philadelphia and Allegheny Counties) have magisterial district judges (formerly called district justices and justices of the peace), who preside mainly over minor criminal offenses and small civil claims. Most criminal and civil cases originate in the Courts of Common Pleas, which also serve as appellate courts to the district judges and for local agency decisions. The Superior Court hears all appeals from the Courts of Common Pleas not expressly designated to the Commonwealth Court or Supreme Court. It also has original jurisdiction to review warrants for wiretap surveillance. The Commonwealth Court is limited to appeals from final orders of certain state agencies and certain designated cases from the Courts of Common Pleas. The Supreme Court of Pennsylvania is the final appellate court. All judges in Pennsylvania are elected; the chief justice is determined by seniority. The state holds 21 electoral votes.
Sales tax provides 39% of Commonwealth's revenue; personal income tax 34%; motor vehicle taxes about 12%, and taxes on cigarettes and alcohol beverage 5%.
Counties, municipalities, and school districts levy taxes on real estate. In addition, some local bodies assess a wage tax on personal income. Generally, the total wage tax rate is capped at 1% of income but some municipalities with home rule charters may charge more than 1%. Thirty-two of the Commonwealth's sixty-seven counties levy a personal property tax on stocks, bonds, and similar holdings.
Pennsylvania's two U.S. Senators in the 111th Congress are Arlen Specter and Bob Casey, Jr.

Thompson (5th), Jim Gerlach (6th), Joe Sestak (7th), Patrick Murphy (8th), Bill Shuster (9th), Chris Carney (10th), Paul E. Kanjorski (11th), John Murtha (12th), Allyson Schwartz (13th), Michael F. Doyle (14th), Charlie Dent (15th), Joe Pitts (16th), Tim Holden (17th), Tim Murphy (18th), and Todd Russell Platts (19th).
In the past decade, no political party has been clearly dominant in Pennsylvania. This, combined with Pennsylvania's rank of 6th in the country in population, has made it one of the most important swing states. Democrats are strong in urban Philadelphia and the areas of Pittsburgh, Reading, Allentown, Erie, Johnstown, State College and Scranton/Wilkes-Barre. Republicans are generally dominant in the vast rural areas that make up the balance of the Commonwealth. Traditionally, Republicans have also fared well in the densely populated and wealthy suburbs of Philadelphia and Pittsburgh, but in the 1990s and 2000s many of these suburbs began to associate more with the Democratic Party.
Since 1992, Pennsylvania has been trending Democratic in Presidential elections, voting for Bill Clinton twice by large margins, and slightly closer in 2000 for Al Gore. In the 2004 Presidential Election, Senator John F. Kerry beat President George W. Bush in Pennsylvania 2,938,095 (50.92%) to 2,793,847 (48.42%). Most recently, in the 2008 Presidential Election, Democrat Barack Obama defeated Republican John McCain in Pennsylvania, 3,184,778 (55%) to 2,584,088 (44%).
Municipalities in Pennsylvania are incorporated as cities of several classes, as boroughs, as townships of several classes, or under home rule charters. A "village," often identified by a roadside sign, is unincorporated, and is merely a locale without distinct boundaries. There are 2,567 municipalities in the state.
There is some confusion about the number of "towns" in Pennsylvania. In 1870, Bloomsburg, the county seat of Columbia County was incorporated as a town, and is recognized by state government publications as "the only incorporated town" in Pennsylvania. However, in 1975, McCandless Township, in Allegheny County adopted a home rule charter under the name "Town of McCandless".
Pennsylvania is home to the nation's first zoo, the Philadelphia Zoo. Other long-accredited AZA zoos include the Erie Zoo and the Pittsburgh Zoo & PPG Aquarium. The Lehigh Valley Zoo and ZOOAMERICA are other notable zoos. The Commonwealth boasts some of the finest museums in the country, including the Carnegie Museums in Pittsburgh, the Philadelphia Museum of Art and several others. One of the unique museums is the Houdini Museum in Scranton, the only building in the world devoted to the legendary magician. Pennsylvania is also home to the National Aviary, located in Pittsburgh.
All 121 state parks in Pennsylvania feature free admission.
Pennsylvania offers a number of notable amusement parks, including Camel Beach, Conneaut Lake Park, Dorney Park & Wildwater Kingdom, Dutch Wonderland, DelGrosso Amusement Park, Hersheypark, Idlewild Park, Kennywood, Knoebels, Lakemont Park, Sandcastle Waterpark, Sesame Place, Great Wolf Lodge and Waldameer Park. Pennsylvania also is home to the largest indoor waterpark resort on the East Coast, Splash Lagoon in Erie.
There are also notable music festivals that take place in Pennsylvania. These include Musikfest in Bethlehem, the Philadelphia Folk Festival, Creation Festival, the Great Allentown Fair and Purple Door.
There are nearly one million licensed hunters in Pennsylvania. Whitetail deer, cottontail rabbits, squirrel, turkey, and grouse are common game species. Pennsylvania is considered one of the finest wild turkey hunting states in the Union, alongside Texas and Alabama. Sport hunting in Pennsylvania is a massive boost for the Commonwealth's economy. A report from The Center for Rural Pennsylvania (a Legislative Agency of the Pennsylvania General Assembly) reported that hunting, fishing, and furtaking generated a total of $9.6 billion statewide.
The Boone and Crockett Club shows that five of the ten largest (skull size) black bear entries came from the state. The state also has a tied record for the largest hunter shot black bear in the Boone & Crockett books at 733 lb (332 kg) and a skull of 23 3/16 tied with a bear shot in California in 1993. The largest bear ever found dead was in Utah in 1975 and second largest was shot by a poacher in the state in 1987. Pennsylvania holds the second most number of Boone & Crockett recorded record black bears at 183 second only to Wisconsin's 299.
There are 69 railroads in the state and 5,100 miles (8,200 km) of railways which is 5th in the nation. There are 134 public-use airports and 6 international airports. The Port of Erie is the state's only Great Lakes port and provides access to the St. Lawrence Seaway. It boasts some of the finest port facilities on the Great Lakes. The port of Pittsburgh is the 2nd largest inland port in the United States. There are 120,000 miles (190,000 km) of highways in the state. SEPTA, based in Philadelphia, is the fifth largest transportation agency in the United States. The Port Authority of Allegheny County, which services Pittsburgh, is the 12th largest transportation agency in the United States.
Pennsylvania is home to many professional sports teams, including the Philadelphia Phillies and Pittsburgh Pirates of Major League Baseball, the Philadelphia Eagles and Pittsburgh Steelers of the National Football League, the Philadelphia 76ers of the National Basketball Association, the Erie Bayhawks of the National Basketball Association Development League, the Philadelphia Flyers and Pittsburgh Penguins of the National Hockey League, and the Philadelphia Soul of the Arena Football League. Among them, these teams have accumulated 7 World Series Championships (Pirates 5, Phillies 2), 14 National League Pennants, 3 pre-Super Bowl era NFL Championships (Eagles), 6 Super Bowl Championships (Steelers), 1 Arena Bowl Championship (Soul), 2 NBA Championships (76ers), and 4 Stanley Cup winners (Flyers 2, Penguins 2).
In baseball, the Phillies moved their Triple A-level team from Ottawa, Ontario, in Canada, to a newly-constructed stadium, Coca-Cola Park in Allentown, beginning with the 2008 season. Because the Lehigh Valley is a core fan base for both the Phillies and the Philadelphia Eagles (who conduct their pre-season training camp on the practice fields of Lehigh University), there are understandably lofty expectations that the new team, called the Lehigh Valley IronPigs (after pig iron, which is an instrumental part in the construction of steel which has been a large part of the local economy for decades), is likely to prove hugely popular among Allentown and Lehigh Valley Phillies fans. The Phillies' AA team is located in Reading, and one of their A-level affiliates is also located in Williamsport. The Tigers AA team is located in Erie. The Pirates' AA team is located in Altoona, and the Nationals' AA affiliate is in the capital of Harrisburg. The Yankees' AAA team is also located in Scranton, in the northeastern part of the state. Two independent-league teams, the Lancaster Barnstormers and York Revolution of the Atlantic League of Professional Baseball, are located in south-central Pennsylvania.
College football is also very popular in Pennsylvania. The Penn State University Nittany Lions are coached by Joe Paterno who led Penn State to two national championships (1982 & 1986) as well as five undefeated seasons (1968, 1969, 1973, 1986 and 1994). Penn State plays its home games in the largest stadium in the United States, Beaver Stadium, that seats 107,282. In addition, the University of Pittsburgh Panthers have won nine national championships (1915, 1916, 1918, 1929, 1931, 1934, 1936, 1937 and 1976) and have played eight undefeated seasons (1904, 1910, 1915, 1916, 1917, 1920, 1937 and 1976). Pitt plays its home games at Heinz Field, a facility it shares with the Pittsburgh Steelers. Other Pennsylvania schools that have won national titles in football include Lafayette College (1896) and the University of Pennsylvania (1895, 1897, 1904 and 1908).
College basketball is also popular in the state, especially in the Philadelphia area where five universities, collectively termed the Big Five, have a rich tradition in NCAA Division I basketball. National titles in college basketball have been won by the following Pennsylvania universities: La Salle University (1954), Temple University (1938), University of Pennsylvania (1920 and 1921), University of Pittsburgh (1928 and 1930) and Villanova University (1985).
In motorsports, the Mario Andretti dynasty of race drivers is from Nazareth. Notable Racetracks in Pennsylvania include the Jennerstown Speedway in Jennerstown, the Lake Erie Speedway in North East, the Mahoning Valley Speedway in Lehighton, the Motordome Speedway in Smithton, the Mountain Speedway in St. Johns, the Nazareth Speedway in Nazareth; and the Pocono Raceway in Long Pond, which is home both the Pennsylvania 500 and the Pocono 500.
Also, the Little League World Series is held in Williamsport, where it was founded. Also the first World Series between the Boston Pilgrims (now Boston Red Sox) and Pittsburgh Pirates was played in Pittsburgh.
There are also two motocross race tracks that host a round of the AMA Toyota Motocross Championships in Pennsylvania. High Point in located in Mt. Morris, PA, and Steel City is located in Delmont, PA.
Race courses for horses in Pennsylvania consist of The Meadows Racetrack, south of Pittsburgh, Mohegan Sun at Pocono Downs, in Wilkes-Barre and Harrah's Chester Casino and Racetrack in Chester which offer harness racing, and Penn National Race Course in Grantville and Philadelphia Park, in Bensalem, and Presque Isle Downs, south of Erie, which offer thoroughbred racing. Smarty Jones, the 2004 Kentucky Derby and Preakness Stakes winner, had Philadelphia Park as his home course.
Arnold Palmer, one of the leading 20th century pro golfers, comes from Latrobe, and Jim Furyk, one of the leading 21-century pro golfers, grew up near in Lancaster. PGA tournaments in Pennsylvania include the 84 Lumber Classic, played at Nemacolin Woodlands Resort, in Farmington and the Northeast Pennsylvania Classic, played at Glenmaura National Golf Club, in Moosic.
Philadelphia is home to LOVE Park, once a skateboarding mecca, and across from City Hall, host to ESPN's X Games in 2001 and 2002.
In his book Yo Mama Cooks Like a Yankee, author Sharon Hernes Silverman calls Pennsylvania the snack food capital of the world. It leads all other states in the manufacture of pretzels and potato chips. The Sturgis Pretzel House introduced the pretzel to America, and companies like Anderson Bakery Company, Intercourse Pretzel Factory, and Snyder's of Hanover are leading manufacturers in the Commonwealth. Two of the three companies that define the U.S. potato chip industry are based in Pennsylvania: Utz Quality Foods, Inc., which started making chips in Hanover, Pennsylvania in 1921, and Wise Snack Foods which started making chips in Berwick in 1921 (the third, Lay's Potato Chips, is a Texas company). Other companies such as Herr Foods, Martin's Potato Chips, Snyder's of Berlin (not associated with Snyder's of Hanover) and Troyer Farms Potato Products are popular chip manufacturers. The U.S. chocolate industry is centered in Hershey, Pennsylvania, with Mars and Wilbur Chocolate Company nearby, and smaller manufacturers such as Asher's near Lansdale and Gertrude Hawk of Dunmore. Other notable companies include Just Born in Bethlehem, PA, makers of Hot Tamales, Mike and Ikes, and the Easter favorite marshmallow Peeps, Benzel's Pretzels and Boyer Brothers of Altoona, PA, which is well known for its Mallo Cups. Auntie Anne's Pretzels started in Maryland, but their corporate headquarters is now located in Lancaster. Traditional Pennsylvania Dutch foods include chicken potpie, schnitz un knepp (dried apples, hame, and dumplings), fasnachts (raised doughnuts), scrapple, pretzels, bologna, and chow-chow. Shoofly is another traditional Pennsylvanian Dutch food. D.G. Yuengling & Son, America's oldest brewery, has been brewing beer in Pottsville since 1829.
Among the regional foods associated with Pennsylvania are pierogies, cheesesteaks, hoagie, soft pretzels, liver on a stick, Italian water ice, scrapple, Tastykake, and strombolis. In Pittsburgh, tomato ketchup was improved by Henry John Heinz from 1876 to the early 1900s. Famous to a lesser extent than Heinz ketchup are the Pittsburgh's Primanti Brothers Restaurant sandwiches. Outside of Scranton, in Old Forge there are dozens of Italian restaurants specializing in pizza made unique by thick, light crust and American cheese. Sauerkraut along with pork and mashed potatoes is a common meal on New Year's Day in Pennsylvania.
Multi-ethnic cuisine is common, especially in the Pittsburgh, Philadelphia, and Coal Region areas. Amish, Chinese, Italian, Indian, Japanese, Korean, Mexican, Pakistani, Persian, Polish, Russian, Thai, Turkish cuisine and many others can be found not only in specialty restaurants but at hundreds of community or religious festivals.
Rick Santorum
Richard John Santorum, KSMOM (born May 10, 1958) is a former United States Senator from the Commonwealth of Pennsylvania. Santorum is a member of the Republican Party and was the chairman of the Senate Republican Conference, the number-three job in the party leadership of the Senate.
Santorum is usually considered a strong social and fiscal conservative but paleoconservatives and paleolibertarians have accused him of being too reliant upon the federal government. He also holds strong neoconservative stances in regard to foreign policy, which has further alienated many paleoconservatives. He is particularly known for his stances on the U.S. invasion of Iraq, Social Security, intelligent design, homosexuality, and the Terri Schiavo case. Santorum was defeated 59% to 41% in the 2006 U.S. Senate election by Democratic candidate Bob Casey, Jr. This was the largest margin of defeat for an incumbent Senator since 1980.
In March 2007, Santorum joined the law firm Eckert Seamans Cherin & Mellott, LLC. He will primarily practice law in the firm’s Pittsburgh and Washington, D.C. offices, where he will provide business and strategic counseling services to the firm's clients. In addition to his work with the firm, Santorum also serves as a Senior Fellow with the Ethics and Public Policy Center in Washington, D.C., and is a contributor to Fox News Channel.
Santorum was born in Winchester, Virginia, and raised in Berkeley County West Virginia and Butler County, Pennsylvania, the son of Aldo Santorum (born 1923) and Catherine Dughi (born 1918). Both his father and maternal grandfather were from Italy.
Both of Santorum's parents worked at the Veteran's Administration Hospital in Butler, and the family lived on the VA hospital post. His father, Aldo, was an immigrant from Italy, and became licensed as a psychologist in August 1974. After attending schools in the Butler Area School District where he gained the nickname "Rooster", allegedly because he "always had a few errant hairs on the back of his head that refused to stay down" (because of an orthodontic head brace), and he was "dogged and determined like a rooster and never backed down".
Santorum graduated from Carmel High School in Mundelein, Illinois in 1976., where his father transferred with in the VA hospital system. He lists his residency as Penn Hills, Pennsylvania, and maintains a home in Leesburg, Virginia, for his work in Washington, D.C. Santorum earned a Bachelor of Arts degree, majoring in Political Science, from Pennsylvania State University in 1980, and a Master of Business Administration degree from the University of Pittsburgh in 1981. He is a member of Tau Epsilon Phi fraternity.
In 1986, Santorum earned a law degree from the Penn State Dickinson School of Law, was admitted to the Pennsylvania bar, and began practicing law in Pittsburgh, Pennsylvania. While working at the law firm of Kirkpatrick & Lockhart, he represented the World Wrestling Federation, arguing that professional wrestling should be exempt from federal anabolic steroid regulations because it was not a sport. Santorum left private practice after first being elected to the House in November 1990.
Santorum and his wife, Karen Garver Santorum, have six children: Elizabeth Anne (born 1991); Richard John ("Johnny"), Jr. (born 1993); Daniel James (born 1995); Sarah Maria (born 1998); Peter Kenneth (born 1999); and Patrick Francis (born 2001). In 1996, their son Gabriel Michael was born prematurely and lived for only two hours (a sonogram taken before Gabriel was born revealed that his posterior urethral valve was closed and that the prognosis for his survival was therefore poor). Karen Santorum wrote a book about the experience: Letters to Gabriel: The True Story of Gabriel Michael Santorum. In it, she writes that the couple brought the deceased infant home from the hospital and introduced the dead child to their living children as "your brother Gabriel" and slept with the body overnight before returning it to the hospital. The anecdote was also written about by Michael Sokolove in a 2005 New York Times Magazine story on Santorum. Karen is also the author of a book on etiquette for children.
Santorum and his family attend Latin Mass at a Roman Catholic Church near Washington, D.C. Occasionally, when not attending Latin Mass, they attend mass at St. Francis De Sales Church in Purcellville, Virginia. On November 12, 2004, Santorum and his wife were invested as Knight and Dame of Magistral Grace of the Knights of Malta in a ceremony at St. Patrick's Cathedral, New York.
Santorum first became actively involved in politics volunteering for the late Senator John Heinz.
After getting his MBA in 1981, Santorum became an administrative assistant to Republican State Senator J. Doyle Corman (until 1986). He was director of the Pennsylvania Senate's local government committee from 1981 to 1984, then-director of the Pennsylvania Senate's Transportation Committee until 1986.
In 1990, at age 32, Santorum was elected to the U.S. House of Representatives from Pennsylvania's 18th District, located in the eastern suburbs of Pittsburgh. He scored a significant upset, defeating a seven-term Democratic incumbent, Doug Walgren. Although the 18th was heavily Democratic, Santorum attacked Walgren for living outside the district for most of the year. He was reelected in 1992, in part because the district lost its share of Pittsburgh as a result of redistricting. In Congress, as a member of the Gang of Seven, Santorum worked to expose congressional corruption by outing the guilty parties in the House banking scandal.
In 1994, at the age of 36, Santorum was elected to the U.S. Senate, defeating the incumbent Democrat, Harris Wofford, who was 32 years his senior. The theme of Santorum's 1994 campaign, as portrayed on his campaign's signs, was "Join the Fight!" Santorum was re-elected in 2000 defeating Congressman Ron Klink by a 52.4% to 45.5% margin.
As Chairman of the Senate Republican Conference, Santorum directed the communications operations of Senate Republicans and was a frequent party spokesperson. He was the youngest member of the Senate leadership and the first Pennsylvanian to hold such a prominent position since Senator Hugh Scott was Republican leader in the 1970s. In addition, Santorum served on the Senate Agriculture Committee; the Senate Committee on Banking, Housing and Urban Affairs; the Senate Special Committee on Aging; and the Senate Finance Committee, of which he was the Chairman of the Subcommittee on Social Security and Family Policy.
In January 2005, Santorum announced his intention to run for United States Senate Republican Whip, the second highest post in the Republican caucus after the 2006 election. The move came because it was presumed the incumbent whip, Mitch McConnell of Kentucky, was viewed as having the inside track to succeeding Bill Frist of Tennessee as Senate Republican leader.
During the lame-duck session of the 109th Congress, Santorum was one of only two senators who voted against Robert Gates to become Secretary of Defense. He cited his opposition to Gates' advocacy of engaging Iran and Syria to solve the problem, claiming that talking to "radical Islam" would be a grievous error.
In September 2005, in an effort to publicly re-align himself with the conservative legacy, Santorum gave a speech that outlined the successes and failures — but, more centrally, the future — of conservatism, at the Heritage Foundation's First International Conservative Conference on Social Justice. In November 2005, he adapted his speech into an op-ed piece for the political website Townhall.com outlining his vision for "Compassionate Conservatism".
What I call "Compassionate Conservatism" has something unique to offer to the shaping of our future.
Compassionate Conservatism relies on healthy families, freedom of faith, a vibrant civil society, a proper understanding of the individual and a focused government to achieve noble purposes through definable objectives which offers hope to all.
Conservatism is based upon the idea of preserving the good in our society, adding to it the wisdom of experience coupled with the courage and optimism of a new generation. This formula inspired Reagan and Thatcher to hope, and to work together to change the world. Let us build upon their example to be a beacon of hope in this troubled world.
I believe we are at war with Islamic fascists and I singled out Iran and Syria as examples of Islamic fascist regimes. Many Muslims say the same thing, and the editors should, too, for it is undeniable.
For my part, I have taken great care to distinguish between the Islamic fascists who are trying to destroy us (and dominate and oppress their fellow Muslims) and the hundreds of millions of Muslims who wish to be free to follow the guidance of their own good judgment.
I am proud to have singled out tyrannical and fanatical Islamic regimes and identified them for what they are: Islamic fascist states that are the world's leading supporters of terrorism. It does no service to the great majority of the world's Muslims to appease such regimes, which have killed and tortured hundreds of thousands of decent Muslims for the "crime" of challenging oppression and calling for freedom.
Santorum has attracted both support and criticism because of his socially conservative and outspoken views, primarily because of his stances on same-sex marriage, homosexuality, and abortion. His views on social and cultural issues are presented in his 2005 book, It Takes a Family, published by the Intercollegiate Studies Institute of Wilmington, Delaware.
Santorum opposed the recent Senate proposal that addressed illegal immigration. Instead, Santorum believes that the US should first act to enforce currently existing laws. He has openly stated his strong opposition to amnesty for illegal immigrants. He supports the construction of a barrier along the U.S.-Mexican border, an increase in the number of border patrol agents on the border, and the stationing of National Guard troops along the border. He also believes that illegal immigrants should be deported immediately when they commit crimes, and that illegal immigrants should not receive benefits from the government. Finally, the former senator believes that English should be established as the national language in the United States.
In 2001, Santorum tried unsuccessfully to insert language which came to be known as the "Santorum Amendment" into the No Child Left Behind bill that sought to promote the teaching of intelligent design while questioning the academic standing of evolution in public schools. The amendment, crafted with the assistance of the Discovery Institute, would have required schools to discuss supposed controversies surrounding scientific topics, and gave the theory of evolution as an example, opening the door for intelligent design as an opposing theory to be presented in science classrooms. A federal court in Santorum's own state, along with the majority of scientific organizations, including the American Association for the Advancement of Science, say the Institute has manufactured the controversy they want to teach by promoting a false perception that evolution is "a theory in crisis", portraying it as being the subject of wide controversy and debate within the scientific community.
Though not included in the final version of the Act made law, the language from the amendment was included in a report attached to the Act known as the Conference Report. The Discovery Institute and many intelligent design proponents, including two Ohio Congressmen, have repeatedly invoked this to suggest that intelligent design should be included in public school science standards as an alternative to evolution.
In a 2002 Washington Times op-ed article Santorum wrote that intelligent design "is a legitimate scientific theory that should be taught in science classes." By 2005 Santorum had adopted the Discovery Institute's Teach the Controversy approach, stating in an interview with National Public Radio "I'm not comfortable with intelligent design being taught in the science classroom. What we should be teaching are the problems and holes, and I think there are legitimate problems and holes in the theory of evolution", a statement which mirrors the Teach the Controversy strategy, the most recent iteration of the intelligent design movement. The day after the Kitzmiller v. Dover Area School District decision that intelligent design is not science and is essentially religious in nature conclusion came down, Santorum announced that he was resigning from the advisory board of the Thomas More Law Center which had defended the Dover school board. Most recently Santorum wrote the foreword for the March 2006 book, Darwin's Nemesis: Phillip Johnson And the Intelligent Design Movement a collection of essays largely by Discovery Institute fellows honoring the "father" of the intelligent design movement, Phillip E. Johnson.
Santorum and U.S. Senator John Kerry, (D-MA), were the lead sponsors of the Workplace Religious Freedom Act (WRFA), which would require employers to accommodate the religious observances of their employees as long as such accommodations would not impose an "undue hardship" on the employer. Thus, employers would be required to afford employees flexible work shifts so that they could observe religious holidays and to permit employees to wear religiously required clothing at work. Versions of the WRFA have been introduced in 1997, 2000, and 2003, but have failed to be enacted.
On April 14, 2005, Santorum introduced the National Weather Service Duties Act of 2005 to "clarify the duties and responsibilities of the National Oceanic and Atmospheric Administration and the National Weather Service (NWS), and for other purposes". This legislation, if enacted, would prohibit the NWS from publishing weather data to the public when private-sector entities, such as AccuWeather, a company based in Santorum's home state, perform the same function commercially. Accuweather employees have contributed at least $5500 to Santorum since 1999, according to the Federal Election Commission.
Opponents of this bill contend that weather data is collected at taxpayer expense, and therefore it should be made freely available to the public, and not provided solely to private corporations that will charge fees for access. They also claim that the vague language in the bill is an attempt to prevent the NWS from issuing free forecasts because such functions are currently provided by the private sector and would be considered competition. Supporters of this bill deny this and say that it does not change the data collection and dissemination functions of NWS.
The bill was never enacted or voted upon, dying in committee.
A controversy arose following Santorum's statements about homosexuality in an interview with the Associated Press that was published on April 20, 2003. In response to a question about how to prevent sexual abuse of children by priests, Santorum said the priests were engaged in "a basic homosexual relationship" with "post-pubescent men", and went on to say that he had "a problem with homosexual acts"; that the right to privacy, as detailed in Griswold v. Connecticut, "doesn't exist in my opinion in the United States Constitution"; that, "whether it's polygamy, whether it's adultery, whether it's sodomy, all of those things are antithetical to a healthy, stable, traditional family"; and that sodomy laws properly exist to prevent acts that "undermine the basic tenets of our society and the family". When the Associated Press reporter asked whether homosexuals should not then engage in homosexual acts, Santorum replied, "Every society in the history of man has upheld the institution of marriage as a bond between a man and a woman. Why? Because society is based on one thing: that society is based on the future of the society. And that's what? Children. Monogamous relationships. In every society, the definition of marriage has not ever to my knowledge included homosexuality. That's not to pick on homosexuality. It's not, you know, man on child, man on dog, or whatever the case may be. It is one thing. And when you destroy that you have a dramatic impact on the quality".
Democratic politicians, including 2004 Democratic presidential candidates, gay rights advocates, and liberal commentators condemned the statements. Republican politicians, religious conservatives, and other conservative commentators supported Santorum and called the condemnations unfair.
Santorum did not retract his remarks, stating that they were intended not to equate homosexuality with incest and pedophilia, but rather as a critique of the specific legal position that the right to privacy prevents the government from regulating consensual acts among adults (such as bigamy, incest, etc.).
Later that day, Senator Ted Kennedy (D-Massachusetts) delivered a personal rebuke to Santorum on the Senate floor, saying "The people of Boston are to blame for the clergy sexual abuse? That is an irresponsible, insensitive and inexcusable thing to say." Santorum has stood by his 2002 article and has not apologized.
On July 21, 2005, Rush Limbaugh interviewed Santorum about Kennedy's speech. Santorum said that he was being targeted by the Democratic Senatorial Campaign Committee, which, he said, coordinated with the media to publicize Kennedy's speech. He argued that his statement about Boston was taken out of context from an article he had written three years earlier. Santorum agreed with Limbaugh's summary that it was "no surprise that the center of the Catholic Church abuse took place in very liberal, or perhaps the nation's most liberal area, Boston." Santorum reiterated his broader theme of a cultural connection, saying that it is "no surprise that the culture affects people's behavior. the liberal culture — the idea that sexual inhibitions should be put aside and people should be able to do whatever they want to do, has an impact on people and how they behave." When asked why Boston specifically was mentioned, Santorum pointed out that, in July 2002, the outrage of American Catholics, as well as his own, was focused on the Archdiocese of Boston.
The campaign of Bob Casey, Jr., his Democratic opponent for the Senate, criticized Santorum's remarks.
Santorum was the sponsor of legislation proposed to prevent the National Weather Service from competing with private-sector weather services, as discussed above.
Santorum added a synthetic-fuel tax-credit amendment to a larger bill introduced in the Senate by Charles Grassley, the Iowa Republican who headed the Senate Finance Committee. Time Magazine called this tax-credit scheme "a multibillion-dollar scam." The amendment was inserted in the Tax Relief Act of 2006, which provides aid for Hurricane Katrina victims and sets new policies for tax-exempt groups.
In November 2004, a controversy developed over education costs for Santorum's children. Santorum's legal address is a three-bedroom house in Penn Hills, Pennsylvania, a suburb of Pittsburgh, which he purchased for $87,800 in 1997 and is located next to Mrs. Santorum's parents. But since 2001, he has lived in Leesburg, Virginia, a town about one hour's drive west of Washington, D.C., and about 90 minutes' drive south of the Pennsylvania border, in a house he purchased for $643,000. The Penn Hills Progress, a local paper, reported that Santorum and his wife paid about $2,000 per year in property taxes on their Pennsylvania home ($487.20 per year to Allegheny County, 2006 through 2008, based on a 2007 value of $106,000 , plus Penn Hills School District tax). The paper also found that another couple — possibly renters — were registered voters at the same address.
At the time the issue arose, Santorum's five older children attended the Western Pennsylvania Cyber Charter School, with 80 percent of tuition costs paid by the Penn Hills School District. At a meeting in November 2004, the Penn Hills School District announced that it did not believe Santorum met the qualifications for residency status, because he and his family spent most of the year in Virginia. They demanded repayment of tuition costs totaling $67,000.
When news reports showed Sen. Santorum was renting his Penn Hills home relatives a three-bedroom Penn Hills house, Santorum withdrew his five children from the cyber education program that Penn Hills School District paid for. That saved Penn Hills taxpayers about $38,000 a year . Although Santorum said he would make other arrangements for his children's education, he insisted that he did not owe the school board any back tuition. Once the controversy surfaced, the children were withdrawn from the cyber school and were then home schooled .
In September 2006, the Pennsylvania Department of Education agreed to pay the district $55,000 to settle the dispute over money withheld from the district to pay for the children of U.S. Senator Rick Santorum to attend a cyber charter school.
The matter rose again in May 2006. Santorum has said that his family stays during holidays and at times on weekends at the Penn Hills house. But the Progress reported in May that the house appeared unoccupied, and Casey's campaign noted that in a press release. Santorum then accused Casey's campaign of supporting trespassing on his property, saying of Casey "Now that he is a nominee, it is time for him to start acting like a candidate instead of a thug." Casey, in a statement, called the charges "false and malicious." His campaign, in a news release, described Santorum's actions as "weirdness".
In September 2006, Santorum formally asked that the county remove the homestead tax exemption from his Penn Hills residence. He said that he had made similar requests to county officials in conversations in 2005 and earlier in 2006, but to no avail. In his letter, Santorum insisted that he was entitled to the exemption, which is worth about $70 annually, but chose not to take advantage of it because of the political dispute. While homeowners in the county are eligible for a tax savings averaging $70 a year on their primary residences, the county council president noted that Santorum had "said during a televised debate that he spends about 30 days in his Penn Hills house each year.".
Allegheny County Election Office records indicate that, while a registered voter in the county, Santorum had since 1995 voted absentee..
The only way for Santorum to not pay for his children's private education was to enroll them in the Penn Hills School District. Virginia state law only requires local school districts to pay for private school tuition fee when a student has disabilities and enrolls in a school that can satisfy his or her needs, according to Charles Pyle, Virginia Department of Education spokesman. Otherwise, children in Virginia must attend their local public schools .
Santorum's supporters have said that the controversy is politically motivated because the school board is controlled by Democrats (Erin Vecchio, the school board member who first publicly raised the issue, is the chair of the local Democratic Party). They also have said that since Santorum votes in Penn Hills and pays property and school taxes there, he is entitled to the same privileges as any other Penn Hills resident and should not be deprived of these privileges as a result of his service in the U.S. Senate. Non-residency issues have raised questions of hyopcrisy, in that Santorum had previously castigated Representative Doug Walgren for moving away from his district..
In June 2006, Santorum declared that weapons of mass destruction (WMD) had been found in Iraq. The specific weapons he referred to were chemical munitions dating back to the Iran–Iraq War that were buried in the early 1990s. The report stated that while agents had degraded to an unknown degree, they remained dangerous and possibly lethal. Officials of the Department of Defense, CIA intelligence analysts, and the White House have all explicitly stated that these expired casings are not part of the WMD threat that Operation Iraqi Freedom was launched to contain.
In 2005 a coalition of animal rights groups, spearheaded by the Humane Society of the United States (HSUS) and the Doris Day Animal League (DDAL) mounted a failed effort to push the Pet Animal Welfare Statute of 2005 (PAWS) through congress. The bill was proposed by Senator Rick Santorum (R-PA) and sponsored by Dick Durbin (D-IL) and Arlen Specter (R-PA). PAWS would have reclassified most small and hobby breeders as commercial breeders subjecting them to USDA regulations, allowed home inspections and placed fees and compliance expenses on pet breeders. Fellow Congressmen were told that PAWS was "the puppy mill bill".
This was Santorum's third failed attempt at pet-related legislation.
In 2005, four teenagers were ejected from a bookstore in Wilmington, Delaware where Santorum was scheduled for a book signing when they were overheard expressing critical opinions of the senator.. The American Civil Liberties Union filed suit, which was settled in 2007. As a result of the settlement, the Delaware State Police were required to pay legal fees for the plaintiffs and provide training to officers on free speech rights. The Santorum staff members who requested the ejection were required to apologize and to relinquish their salaries for the event—$2,500.00—to plaintiffs in damages.
As a key member of the Gang of Seven (a group of seven freshmen Republican Congressmen), Santorum helped expose a scandal at the House Bank. The Gang of Seven's reform-minded agenda is often cited as a foundation of the 1994 Republican takeover of the House of Representatives.
In 1996, as a U.S. Senator, Santorum served as Chairman of the Republican Party Task Force on Welfare Reform and was the author and key sponsor of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996. The legislation passed with overwhelming bipartisan support and was signed into law by President Bill Clinton.
Though not a named author of the special Schiavo legislation, Santorum played a key role in shepherding the bill through the Senate to a vote on March 20, 2005. Santorum has frequently stated that he does not believe a "right to privacy" exists under the Constitution, even within marriage; he has been especially critical of the Supreme Court decision in Griswold v. Connecticut (1965), which held that the Constitution guaranteed the aforementioned right, and on that basis, overturned a law prohibiting the sale and use of contraceptives.
Santorum is also a supporter of partial privatization of Social Security. Since the 2004 presidential election, Santorum has held forums across Pennsylvania on the topic.
In 2005, Santorum sponsored the Iran Freedom and Support Act, which appropriated $10 million aimed at regime change in Iran. The Act passed with overwhelming support. However, Santorum nevertheless voted against the Lautenberg amendment which would have closed the loophole which allows companies like Halliburton to do business with Iran through their foreign affiliates.
Santorum is well known for attracting political enemies on the other side of his aisle. Senator Bob Kerrey of Nebraska, after sharing the floor with Santorum for the first three weeks of his first term in the Senate, remarked, "Santorum — That's Latin for asshole".
In 2006, Santorum sought re-election to a third term in the U.S. Senate. His Democratic opponent was State Treasurer Bob Casey, Jr., the son of popular former governor Robert Casey, Sr.(D) Santorum's seat was a prime target of Democratic efforts to gain Senate seats in the 2006 elections. Casey's candidacy was bolstered by his opposition to abortion, negating one of Santorum's key issues.
Republican strategists took as a bad omen Santorum's primary result in 2006, in which he ran unopposed for the Republican nomination. Republican gubernatorial nominee Lynn Swann, also unopposed, garnered 22,000 more votes statewide than Santorum in the primary, meaning thousands of Republican voters abstained from endorsing Santorum for another Senate term. This may have been partly due to Santorum's support for Arlen Specter, over Congressman Pat Toomey in the 2004 Republican primary for the U.S. Senate. Even though Santorum is only slightly less conservative than Toomey, he joined virtually all of the state and national Republican establishment in supporting the moderate Specter. This led many socially and fiscally conservative Republicans to consider Santorum's support of Specter to be a betrayal of their cause.
On May 22, 2006, the polling firm Rasmussen Reports declared that Santorum was the "most vulnerable incumbent" among the Senators running for re-election. However, in August 2006, polling showed Santorum with his highest approval rating in months, 48 percent, a twelve-point jump between July and August. Nearly as many Pennsylvanians, 45 percent, said they had an unfavorable view of the Senator.
For most of the campaign, Santorum was behind by 15 points or more. Most polls during the summer of 2006 showed the race between Casey and Santorum becoming increasingly competitive, but a poll released by Quinnipiac University on September 26 showed Casey's margin ballooning back to a double-digit lead.
One day before the Quinnipiac poll was released, a Pennsylvania state judge ruled against a potential third-party candidate, Carl Romanelli of the Green Party. Romanelli fell about 8,900 petition signatures shy of the threshold needed to be placed on the statewide ballot in November. On October 4, 2006, the Pennsylvania State Supreme Court also rejected Romanelli's legal challenge. This was a potential blow to the Santorum campaign, as Romanelli was expected to siphon off some Casey voters.
There is also some question as to whether Romanelli and Pennsylvania's Green Party violated federal election laws when they accepted tens of thousands of dollars in donations from people also backing Santorum's campaign.
Santorum found himself mired in controversy over his residency. For many years, he has maintained a modest home in Penn Hills, a suburb of Pittsburgh, which he claims as his official residence. However, his family lived in the Virginia suburbs of Washington when the Senate was in session. Since this meant Santorum spent most of the year away from Pennsylvania, critics argued it was not unlike the living arrangements he denounced in his 1990 House race against Walgren. Santorum accused Walgren of being out of touch with his Pittsburgh-area district, symbolized by his home in the Virginia suburbs. On NBC's Meet the Press on September 3, 2006, Santorum admitted that he only spends "maybe a month a year, something like that" at his Pennsylvania residence. Santorum also pointed out in the debate that Walgren lived in a single Congressional district and that Walgren only spent 28 days of the entire year in his district, while he represents all of Pennsylvania. As such, he spent much of his time in Virginia but would visit every one of the 67 counties in Pennsylvania every year.
Santorum also drew criticism for enrolling five of his six children in an online "cyber school" in Pennsylvania's Allegheny County (home to Pittsburgh and most of its suburbs), despite the fact the children lived in Virginia. The Penn Hills School District was billed $73,000 in tuition for the cyber classes.
At least one of Santorum's television ads called into question his campaign's use of the facts regarding Casey and persons who have donated money to the Casey campaign. According to the ad, some of the persons who have given Casey money are or have been under investigation for various crimes. An editorial in Casey's hometown newspaper, The Scranton Times-Tribune, points out that all but one of the contributions " made to Casey campaigns when he was running for other offices, at which time none of the contributors were known to be under investigation for anything." In fact, two of the persons cited in the Santorum campaign ad have actually given contributions to Mr. Santorum's 2006 Senate campaign. Another died in 2004. However, the Santorum campaign pointed out that the money the Santorum campaign received from those donors was not kept by the campaign, but rather donated to educational institutions.
A heated debate between the candidates occurred on October 11, 2006. There, according to coverage by Pittsburgh Post-Gazette, the candidates appeared "less statesmanlike than either Gov. Ed Rendell or challenger Lynn Swann, who had debated each other in Pittsburgh the week".
Santorum wrote that many women have disclosed to him that it is more "socially affirming to work outside the home than to give up their careers to take care of their children.... What happened in America so that mothers and fathers who leave their children in the care of someone else - or worse yet, home alone after school between three and six in the afternoon - find themselves more affirmed by society? Here, we can thank the influence of radical feminism." Polls showed many female voters resented this description of why they worked, especially Republican and independent women whose abandonment of Santorum doomed his campaign, reported the online news service Capitolwire, based in Harrisburg. In a question-and-answer session on Aug. 28 at the Pennsylvania speech, Santorum tried again to address the issue and said his problem was that federal taxes now consumed 27 percent of family wages, and the second wage earner in most families made only 25 percent of the first's wages.
In the November election, Santorum lost, with 41% of the vote to Casey's 59%, statistically the worst defeat ever for an incumbent Republican Senator in Pennsylvania and the largest margin of defeat for an incumbent Senator since George McGovern lost his reelection bid to James Abdnor in 1980.
Before failing to win reelection in 2006, Santorum had frequently been mentioned as a possible 2008 presidential candidate. Such speculation faded when, during the course of the campaign and in light of unimpressive poll numbers, he declared that, if re-elected, he would serve a full term. After he lost, Santorum once again ruled out a presidential run.
On April 12, 2007, political action committee America's Foundation, Highmark and a former Highmark vice president were fined by the Federal Election Committee for sponsoring Santorum with corporate money. The problem had been reported by Highmark, which uncovered the matter during an internal review.
Dismissal of U.S. attorneys controversy
The dismissal of U.S. Attorneys controversy is a United States political scandal initiated by the unprecedented midterm dismissal of seven United States Attorneys on December 7, 2006 by the George W. Bush administration's Department of Justice. Congressional investigations focused on whether the Department of Justice and the White House were using the U.S. Attorney positions for political advantage. Allegations were that some of the attorneys were targeted for dismissal to impede investigations of Republican politicians or that some were targeted for their failure to initiate investigations that would damage Democratic politicians or hamper Democratic-leaning voters. The U.S. attorneys were replaced with interim appointees, under provisions in the 2005 Patriot Act reauthorization.
The U.S. Attorneys controversy touches upon a wide range of issues. The U.S. Attorneys, in their pursuit of justice, wield enormous power. Their political impartiality in deciding which cases to prosecute and in arguing those cases before judges and juries with diverse views is essential. Broadly, the U.S. Attorneys controversy was symptomatic of, and exposed, a pattern of inappropriate political and ideological influences within the U.S. Department of Justice. The scandal pitted Congress against the Bush White House, generating a series of constitutional issues. As the controversy unfolded, it led to other controversies, notably the politicization of hiring at the U.S. Department of Justice, the Bush White House e-mail controversy, and the alleged politically-motivated prosecutions by U.S. Attorneys in several states.
The following sections briefly summarize aspects of the controversy. More thorough analyses are further below, or in the related articles.
As the controversy emerged, U.S. Senators were concerned about a little-noticed provision in the re-authorization of the USA PATRIOT Act in 2006 which eliminated the 120-day term limit on interim appointments of U.S. Attorneys made by the United States Attorney General to fill vacancies. The change gave the Attorney General greater appointment powers than the President and undermined the confirmation authority of the Senate. Presidential appointees must be confirmed by the Senate, but the Attorney's General did not require Senate confirmation. The U.S. Senate was concerned that, in dismissing the U.S. Attorneys, the administration planned to fill the vacancies with its own choices, thus bypassing not only the Senate confirmation, but also the traditional consultation with Senators in the selection process. Congress rescinded the provision by very large majorities in March 2007.
The reasons for the dismissal of each individual U.S. Attorney were unclear. Two suggested motivations were that the administration wanted to make room for U.S. Attorneys that were more sympathetic to the administration's political agenda, and the administration wanted to advance the careers of promising conservatives. Critics said that the attorneys were fired for failing to prosecute Democratic politicians, for failing to prosecute claims of election fraud that would hamper Democratic voter registration, or as retribution for prosecuting Republican politicians. The administration and its supporters said that the attorneys were dismissed for job-performance reasons "related to policy, priorities and management," and that U.S. Attorneys serve at the pleasure of the President. However, at least six attorneys had recently received positive evaluations of their performance from the Department of Justice. In September 2008, the Department of Justice Inspector General's investigation concluded that the dismissals were politically motivated and improper.
Members of Congress investigating the dismissals found that sworn testimony from Department of Justice officials appeared to be contradicted by internal Department memoranda and e-mail, and that possibly Congress was deliberately misled. The White House role in the dismissals remained unclear despite hours of testimony by Attorney General Gonzales and senior Department of Justice staff in congressional committee hearings. The Bush administration issued changing and contradictory statements about the timeline of the planning of the firings, persons who ordered the firings, and reasons for the firings. The origin and evolution of the list of attorneys to be dismissed remained unclear. In response the Inspector General's report in September 2008, Attorney General Michael Mukasey appointed a special prosecutor to determine if administration officials had perjured themselves in testimony to Congress.
Attorney General Gonzales, in a confidential order dated March 1, 2006 not published in the Federal Register, formally delegated authority to senior DOJ staff Monica Goodling and Kyle Sampson to hire and dismiss political appointees and some civil service positions. On May 2, 2007, the Department of Justice announced two separate investigations into hirings conducted by Goodling: one by the department's Inspector General, and a second by the Office of Professional Responsibility. In testimony before the House Judiciary Committee, on May 23, 2007, Goodling stated that she had "crossed the line" and broke civil service laws regulating hiring for civil service positions, and had improperly weighed political factors in assessing applicants.
According to a January 2009 Justice Department report, investigators found that Bradley Schlozman, as interim head of the Civil Rights Division at the Department of Justice, "favored applicants with conservative political or ideological affiliations and disfavored applicants with civil rights or human rights experience whom he considered to be overly liberal." The positions under consideration were not political, but career, for which the political and ideological views of candidates are not to be considered, according to federal law and guidelines.
In a May 30, 2007 letter to the Senate Judiciary Committee, the United States Department of Justice Office of the Inspector General and Counsel for the Office of Professional Responsibility confirmed that they were expanding their investigation beyond "the removals of United States Attorneys" to also include "DOJ hiring and personnel decisions" by Monica Goodling and other Justice Department employees.
The controversy surrounding the U.S. Attorneys dismissals was often linked to elections or voter-fraud issues. Allegations were that some of the U.S. Attorneys were dismissed for failing to instigate investigations damaging to Democratic politicians, or for failing to more aggressively pursue voter-fraud cases. Such allegations were made by some of the dismissed U.S. Attorneys themselves to suggest reasons they may have been dismissed. The background to the allegations is the recent tendency for elections in parts of the United States to be very close; an election outcome can be affected by a mere announced investigation of a politician. Indeed, it is explicit policy of the Department of Justice to avoid bringing voter-related cases during an election for this reason.The pursuit of voter fraud cases was an acknowledged political strategy of the Republican Party by 2006. The use of U.S. Attorneys for partisan purposes is highly improper, particularly given the strong non-partisan traditions of the U.S. Attorneys. In September 2008, the Inspector General for the Department of Justice concluded that some of the dismissals were motivated by the refusal of some of the U.S. Attorneys to prosecute voter fraud cases during the 2006 election cycle.
In June 2008, a grand jury was empaneled to consider criminal indictments against officials involved in the firings. The grand jury was presented evidence from ongoing investigations at the Department of Justice Inspector General’s office and at the DOJ's Office of Professional Responsibility.
In January 2005, Deputy White House Chief of Staff Karl Rove asked deputy counsel David Leitch "how we planned to proceed regarding U.S. Attorneys, whether we were going to allow all to stay, request resignations from all and accept only some of them, or selectively replace them, etc." In reply, Kyle Sampson, then Department of Justice counsel to Attorney General John Ashcroft, wrote that it would be "weird to ask them to leave before completing at least a 4-year term", that they "would like to replace 15–20 percent of the current U.S. Attorneys" and that the rest "are doing a great job, are loyal Bushies, etc." The White House at one time suggested that the plan for dismissals came from White House counsel Harriet Miers, who left the White House in January 2007 before the dismissal received public attention.
In February 2005, Sampson became Deputy Chief of Staff and Counselor to Attorney General Alberto Gonzales.
In March 2005, Sampson "came up with a checklist. He rated each of the U.S. Attorneys with criteria that appeared to value political allegiance as much as job performance. He recommended retaining 'strong U.S. Attorneys who have... exhibited loyalty to the President and Attorney General.' He suggested 'removing weak U.S. Attorneys who have... chafed against Administration initiatives'".
In September 2005, Sampson became Gonzales's Chief of Staff at the Department of Justice.
On February 12, 2006, Monica Goodling sent a spreadsheet of each U.S. Attorney's political activities and memberships in conservative political groups, in an email to senior Administration officials, with the comment "This is the chart that the AG requested".
On December 7, 2006, Justice Department official Michael A. Battle informed seven U.S. Attorneys that they were being dismissed.
Although seven attorneys were dismissed on December 7, 2006, subsequent disclosures show that three or more additional attorneys were dismissed under similar circumstances between 2005-2006. U.S. Attorney Bud Cummins in Arkansas had been informed in June 2006 that he was to be replaced, and he resigned, effective December 20, 2006, several days after the public announcement of the appointment of his successor Timothy Griffin.
The initial reaction was from the senators of the affected states. The U.S. Senate convened for the 110th Congress on January 4 with its new Democratic majority. The Senate Judiciary Committee has oversight over the U.S. Attorneys. In a letter to Gonzales on January 9, 2007 Senators Feinstein (D, California) and Leahy (D, Vermont; Chair of the Committee) of the Senate Judiciary Committee expressed concern that the confirmation process for U.S. attorneys would be bypassed, and on January 11, they, together with Senator Pryor (D, Arkansas), introduced legislation "to prevent circumvention of the Senate’s constitutional prerogative to confirm U.S. Attorneys," called Preserving United States Attorney Independence Act of 2007, S. 214 and H.R. 580. Feinstein issued a press release about the bill. The initial concern was about the Patriot Act and the confirmation process, rather than the politicization of the U.S. Attorneys that later dominated the controversy.

Gonzales testified before the Senate Judiciary Committee on January 18. He assured the committee that he did not intend to bypass the confirmation process and denied the firings were politically motivated.
However, McNulty's testimony that the attorneys were fired for "performance related issues" caused the attorneys to come forward in protest. Indeed, there is some evidence that the administration was concerned about the attorneys going public with complaints prior to this time.
These proceedings were politically charged. At one point Senator Schumer was criticized by Senator Specter (R, Pennsylvania), also on the Judiciary Committee, for having a conflict of interest by being a lead investigator of the affair while also chairing the Democratic Senatorial Campaign Committee; such criticism was short-lived.
On March 5, 2007 effective March 16, Michael A. Battle resigned his position of Director of the Executive Office for United States Attorneys (EOUSA).
Despite the President's position against aides testifying, on March 21 the House Judiciary Committee authorized the subpoena of five Justice Department officials, and on March 22, the Senate Judiciary Committee authorized subpoenas as well.
Sampson's replacement as the Attorney General's temporary chief of staff was U.S. Attorney for the Eastern District of Virginia, Chuck Rosenberg. Rosenberg initiated a DOJ inquiry into possibly inappropriate political considerations in Monica Goodling's hiring practices for civil service staff. Civil service positions are not political appointments and must be made on a nonpartisan basis. In one example, Jeffrey A. Taylor, interim U.S. attorney for the District of Columbia, tried to hire a new career prosecutor, Seth Adam Meinero, in the fall of 2006. Goodling judged Meinero too "liberal" and declined to approve the hire. Meinero, a Howard University law school graduate who had worked on civil rights cases at the Environmental Protection Agency, was serving as a special assistant prosecutor in Taylor's office. Taylor went around Goodling, and demanded Sampson's approval to make the hire. In another example, Goodling removed an attorney from her job at the Department of Justice because she was rumored to be a lesbian, and, further, blocked the attorney from getting other Justice Department jobs she was qualified for. Rules concerning hiring at the Justice department forbid discrimination based on sexual orientation.
On April 25, 2007, the House Judiciary Committee passed a resolution, by a 32-6 vote, authorizing lawyers for the House to apply for a court order granting Goodling immunity in exchange for her testimony and authorizing a subpoena for her. On May 11, 2007 U.S. District Court Chief Judge Thomas Hogan signed an order granting Goodling immunity in exchange for her truthful testimony in the U.S. Attorney firings investigation, stating that "Goodling may not refuse to testify, and may not refuse to provide other information, when compelled to do so" before the Committee.
The United States Congress's House Committee on the Judiciary and the Senate Committee on the Judiciary have oversight authority over Department of Justice (DOJ). In 2007 the two committees conducted a number of public and closed-door oversight and investigative hearings on the topic of the dismissal of U.S. attorneys, and DOJ's interactions with the White House and with staff members of the Executive Office of the President. A routine oversight hearing on January 18, 2007 by the Senate committee with Attorney General Alberto Gonzales was the first public congressional occasion that Gonzales responded to questions about the dismissed attorneys. Through the winter and spring, appearing in more than eleven public committee hearings were a number of key players in the controversy, past and continuing DOJ officials, dismissed U.S. Attorneys, and others. Some individuals appeared at the invitation of the committees, and some appeared only under the compulsion of committee-issued subpoena. One former DOJ official Monica Goodling testified in May 2007, only after the grant of a limited "use" immunity, after reserving the right to not incriminate herself. The two committees made public through their web sites thousands of pages of documents and correspondence that had been subpoenaed from the Department of Justice, individuals, and other organizations.
On July 11, 2007, Sara Taylor, former top aid to Karl Rove, testified before the Senate Judiciary Committee. She was granted the unusual allowance of having her attorney, Neil Eggleston, next to her at the witness table to advise her on which questions she could answer and remain in accord with Bush's claim of Executive Privilege.
On July 17, 2007 Sanchez and Conyers notified White House Counsel Fred Fielding that they were considering the executive privilege claims concerning a "subpoena issued on June 13 to Joshua Bolten, White House Chief of Staff, to produce documents." Warning him that "If those objections are overruled, you should be aware that the refusal to produce the documents called for in the subpoena could subject Mr. Bolten to contempt proceedings". The panel then ruled the claims of privilege as invalid on a party-line vote of 7-3.
The White House has consistently refused to provide the sought after documents but has "offered to permit former and current aides to talk with lawmakers behind closed doors -- but without a transcript and not under oath." This offer has been rejected by the Democratic Leadership in the House as unacceptable.
On February 14, 2008 the full United States House of Representatives voted 223-32 to pass the contempt resolutions against White House Chief of Staff Joshua Bolten and former White House Counsel Harriet Miers.
CNN reported a larger question concerning the lost e-mails: "Whether White House officials such as political adviser Karl Rove are intentionally conducting sensitive official presidential business via non-governmental accounts to evade a law requiring preservation -- and eventual disclosure -- of presidential records." On May 2, 2007, the Senate Judiciary Committee issued a subpoena to Attorney General Gonzales compelling the Department of Justice to produce all email from Karl Rove regarding evaluation and dismissal of attorneys that was sent to DOJ staffers, no matter what email account Rove may have used, whether White House, National Republican party, or other accounts, with a deadline of May 15, 2007 for compliance. The subpoena also demanded relevant email previously produced in the Valarie Plame controversy and investigation for the CIA leak scandal (2003).
On May 24, 2007, Senators Charles Schumer (D-NY), Dianne Feinstein (D-CA), and Sheldon Whitehouse (D-RI) of the Senate Judiciary Committee announced the Democrats' proposed no-confidence resolution to vote on whether "Attorney General Alberto Gonzales no longer holds the confidence of the Senate and the American People." The resolution would have had no legal effect, but was designed to persuade Gonzales to depart or President Bush to seek a new attorney general. A similar resolution was introduced in the House by Rep. Adam Schiff (D-CA). On June 11, 2007, the resolution failed when a Senate vote failed to obtain the 60 votes required for cloture. The vote was 53 for, 38 against with 7 not voting, 1 voting "present", and one vacant senate seat.
University of Missouri law professor Frank Bowman observed that Congress has the power to impeach Gonzales if he willfully lied or withheld information from Congress during his testimony about the dismissal of U.S. Attorneys. On July 30, 2007, Rep. Jay Inslee (D-WA) announced that he would introduce a bill that would require the House Judiciary Committee to begin an impeachment investigation against Gonzales.
Gonzales submitted his resignation as Attorney General effective September 17, 2007, by a letter addressed to President Bush on August 26, 2007. In a statement on August 27, Gonzales thanked the President for the opportunity to be of service to his country, giving no indication of either the reasons for his resignation or his future plans. Later that day, President Bush praised Gonzales for his service, reciting the numerous positions in Texas government, and later, the government of the United States, to which Bush had appointed Gonzales. Bush attributed the resignation to Gonzales' name having been "dragged through the mud" for "political reasons". Senators Schumer (D-NY), Feinstein (D-CA) and Specter (R-PA) replied that the resignation was entirely attributable to the excessive politicization of the Attorney General's office by Gonzales, whose credibility with Congress, they asserted, was nonexistent.
On September 17, 2007, President Bush announced the nomination of ex-Judge Michael B. Mukasey to serve as Gonzales' successor.
Bills to rescind the controversial Patriot Act provision were approved by very large majorities in the Senate and the House prior to the end of March, 2007. Ultimately S.214 was signed into law by the President on June 14, 2007, designated Public Law No: 110-34. The new law specified that all interim attorneys then in office shall serve terms ending 120 days from the signing of the bill.
In May 2007 there were 22 U.S. attorney positions out of 93 that were not held by a presidentially nominated occupant: either acting (filled by civil service First Assistant U.S. Attorneys), or interim (nearly all appointed by the Attorney General). Only four nominees have been submitted by the administration for the 22 positions, though White House spokesperson Tony Fratto was reported saying that the administration is committed to nominating candidates for all 22 positions. Fratto said the number of new nominees "has nothing to do with recent events. The closer you get toward the end of the second term, you're going to have fewer people." David Iglesias, the dismissed New Mexico U.S. attorney, said that the administration is in denial if it doesn't believe there are concerns about low office morale, the ability to remain independent or even the odds of being confirmed by a suspicious Senate controlled by the Democrats.
Timothy Griffin, the interim attorney for Eastern Arkansas, announced in February 2007 that he would not seek a presidential nomination. In early February, Deputy Attorney General McNulty had testified that a vacancy was specifically created for Griffin by dismissing Bud Cummins. Griffin said that he did not believe he would get a "fair consideration" from the Senate.
Interim U.S. Attorneys appointed under the provisions of the Patriot Act Re-authorization were not term limited. Timothy Griffin's continuing term was challenged in court, but Judge G. Thomas Eisele rejected the challenge, finding that Griffin held the position under the USA PATRIOT Act provision that allowed unlimited-term appointments. Under the previous law, Griffin's term would have been limited to 120 days, which would have expired in mid-April 2007. Legislation restoring the term limits to interim U.S. Attorneys (S214) also limits the terms of those interim U.S. Attorneys appointed under the Patriot Act Reauthorization to 120 days from the time of enactment of the legislation, which was June 14, 2007.
On September 29, 2008 the Justice Department's Inspector General (IG) released a report on the matter that found most of the firings were politically motivated and improper. The next day Attorney General Michael Mukasey appointed a special prosecutor, Nora Dannehy, to decide whether criminal charges should be brought against Gonzales and other officials involved in the firings.The IG's report contained "substantial evidence" that party politics drove a number of the firings, and IG Glenn Fine said in a statement that Gonzales had "abdicated his responsibility to safeguard the integrity and independence of the department." The report itself stopped short of resolving questions about higher White House involvement in the matter, because of what it said were the refusal to cooperate of a number of key players, among them Karl Rove, Senator Pete Domenici and Harriet Miers and because the White House refused to hand over its documents related to the firings.
The President of the United States has the authority to appoint U.S. Attorneys, with the consent of the United States Senate, and the President may remove U.S. Attorneys from office. In the event of a vacancy, the United States Attorney General is authorized to appoint an interim U.S. Attorney. Before March 9, 2006, such interim appointments expired after 120 days, if a Presidential appointment had not been approved by the Senate. Vacancies that persisted beyond 120 days were filled through interim appointments made by the Federal District Court for the district of the vacant office.
Senate-confirmed appointments to the Department of Justice (DOJ) offices, particularly U.S. Attorneys, are political in nature. Appointments to U.S. Attorney positions are often made in consultation with individual senators representing the state with the vacant position, typically with some emphasis in consulting Senators of the same party as the President.
The USA PATRIOT Act Improvement and Reauthorization Act of 2005, signed into law March 9, 2006, amended the law for the interim appointment of U.S. Attorneys by deleting two provisions: (a) the 120-day maximum term for the Attorney General's interim appointees, and (b) the subsequent interim appointment authority of Federal District Courts. (See Law references for the text to the statute (28 U.S.C. § 546), and its amendments.) With the revision, an interim appointee can potentially serve indefinitely (though still removable by the President), if the President declines to nominate a U.S. Attorney for a vacancy, or the Senate either fails to act on a Presidential nomination, or rejects a nominee that is different than the interim appointee.
The change was written into the bill by Republican Senator Arlen Specter when the bill was modified in joint conference committee, reconciling the Senate and House versions of the bill. During Senate hearings on February 6, 2007, Senator Specter stated that Brett Tolman, a committee staffer, had inserted the clause on behalf of the Department of Justice. Specter stated that the change in the law had been partly to address separation of powers concerns expressed by a number of court districts, the issue being the interim appointments of U.S. Attorneys (executive branch) by the courts (judicial branch). The courts had appointed U.S. Attorneys for over a hundred years, however. The Department of Justice had been seeking a way to appoint U.S. Attorneys without Senate approval prior to 2005.
On March 20, 2007, the Senate voted 94-2 to re-instate the 120-day term limit on interim attorneys appointed by the Attorney General. On March 26, the U.S. House voted to reinstate the 120-day term limit as well, by a vote of 329-78. The bill was eventually passed in identical form by both houses in May 2007 and was signed into law by the President on June 14, 2007.
Another change to the laws governing the appointment of U.S. Attorneys concerned the residency requirements. The Patriot Act re-authorization included a provision that allowed U.S. Attorneys to reside outside of their appointed state. William W. Mercer authored the change in the law. He held two positions at the same time, the U.S. Attorney for Montana, and the Acting Associate Attorney General while residing in Washington. D.C. Senator Jon Tester (D,Montana) called for Mercer to resign. In the summer of 2007, Mercer resigned from his Acting Associate Attorney General office, and withdrew his presidential nomination for the same office, and returned to Montana to his other position, U.S. Attorney for the District of Montana.
By tradition, U.S. Attorneys are replaced only at the start of a new White House administration. U.S. Attorneys hold a "political" office, and therefore they are considered to "serve at the pleasure of the President." At the beginning of a new presidential administration, it is traditional for all 93 U.S. Attorneys to submit a letter of resignation. When a new President is from a different political party, almost all of the resignations will be eventually accepted. The attorneys are then replaced by new political appointees, typically from the new President's party.
In contrast to the 2006 dismissals, Presidents rarely dismiss U.S. attorneys they appoint. Kyle Sampson, Chief of Staff at the Department of Justice, noted in a January 9, 2006, e-mail to Harriet Miers: "In recent memory, during the Reagan and Clinton Administrations, Presidents Reagan and Clinton did not seek to remove and replace U.S. Attorneys they had appointed, but instead permitted such U.S. Attorneys to serve indefinitely under the holdover provision" (underlining original). There is no precedent for a President to dismiss several U.S attorneys at one time while in the middle period of the presidential term in office.
The few examples of forced dismissals available are based on misconduct. The Congressional Research Service investigated the precedent of dismissing U.S. Attorneys over the 25 years 1981-2006 and identified 54 attorneys who did not serve their full 4-year term. Of these, only two were documented involuntary dismissals: William Kennedy in 1982 and J. William Petro in 1984. Both were Reagan appointees. Kennedy was dismissed for "for asserting that the CIA had pressured DOJ to pressure him not to pursue a case," and Petro was dismissed for "disclosing information about an indictment." However, all of the U.S. Attorneys dismissed in 2006 were in office longer than four years, and appointments lasting into a President's second term were beyond the scope of the study. Before 1981, President Carter replaced U.S. Attorney David Marston at the request of Democratic Representative Joshua Eilberg. Marston had been investigating corruption charges against Eilberg and Daniel Flood, another Democratic Representative. The probe continued after the attorney was replaced, however, and Eilberg lost his 1978 reelection bid. Eilberg was eventually sentenced to five years probation and a $10,000 fine, and Flood was censured for bribery by 96th United States Congress.
